Exclusions

The following events are excluded under this policy and no benefits will be payable:

1. Any claim arising whilst on Your order or with Your permission or to Your knowledge the Motor Vehicle is:

   a. being used otherwise than in accordance with the Usage as stated in the Registration Card of Your vehicle.

   b. being driven by any person other than an Authorized Driver or for the purpose of being driven by him in charge of such person.

2. Any liability which attaches by virtue of an agreement but which would not have attached in absence of such agreement.

3. Any sum which the Insured would have been entitled to recover from any party but for an agreement between you and such party.

4. Death or bodily injury to any person where such death or injury arises out of and in the course of employment of such person by you or by your authorized driver.

5. Any liability caused, sustained or incurred whilst Your Vehicle, in respect of which indemnity is provided by this Policy, is being driven by any person other than an Authorized Driver or a person driving on your order or with your permission.

6. Death of or bodily injury to any person being carried in or upon or entering or getting on to or alighting from the Motor Vehicle at the time of the occurrence of the event out of which any claim arises. This Exception is not applicable to Buses.

7. Any liability to any person who is a member of your household or your authorized driver and/or attendant who is a passenger in your vehicle.

8. Death or bodily injury caused by or arising out of the explosion of a boiler forming part of attached to or on Your Vehicle except so far as is necessary to meet the requirements of the legislation.

9. Any liability of whatsoever nature directly or indirectly caused by or contributed to or arising from ionizing radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel. For the purposes of this exception combustion shall include any self-sustaining process of nuclear fission.

10. Any liability directly or indirectly caused by or contributed to or arising from nuclear weapons material.

11. Any accident loss damage or liability caused sustained or incurred outside of the Kingdom of Cambodia.

12. Death or bodily injury to any person or damage to property caused or arising outside the limits of any carriageway or thoroughfare in connection with the loading onto and unloading from Your Vehicle.

13. Any liability is caused by invasion, war (whether war be declared or not), warlike operation, acts of foreign enemies, hostilities, civil war, acts of terrorism, strike, riot, civil commotion, mutiny, rebellion, revolution, insurrection, military or usurped power or by any direct or indirect consequenes of any of the said occurrences.

14. a. Compensation for damages in respect of judgments not delivered or obtained from a Court of competent jurisdiction within the Kingdom of Cambodia.

      b. Costs and expenses of litigation recovered by any claimant from you which are not incurred in and recoverable in the Kingdom of Cambodia.

15. If you or any person with your consent are not licensed to drive the vehicle except if you or any person with your consent has held and is not disqualified from holding or obtaining such a license to drive your vehicle under any required laws, by-laws and regulations.

16. If you or your authorized driver drives your vehicle whilst under the influence of drink or drug to such an extent as to be incapable of having control of your vehicle.

17. If your vehicle is used for or is being tested in preparation for any motor sport or competition (other than treasure hunts). This includes (but is not limited to) reliability trials, hill-climbing tests and rallies.

18. Any liabilities caused by or arising from criminal liability, civil penalties, fines, traffic offenses, or punitive damages

19. An accident which is not reported to us within 24 hours from the time of accident.
